5 Things to Know About Accidents on the Turnpike and Route 440, With Guidance From The Law Offices of Anthony Carbone

The New Jersey Turnpike’s Hudson County Extension and Route 440 carry a large share of the trucks, commuters, and port traffic moving through Jersey City and Bayonne. Crashes on these roads raise questions that don’t come up on a side street: who investigates, which agency owns the road, and how commercial insurance changes the claim. Here are five things to know, followed by local law offices, starting with The Law Offices of Anthony Carbone.

What should you know after a crash on the Turnpike or Route 440?

    1. Who investigates the crash, and where do you get the report?

It depends on the road. The New Jersey State Police patrol the Turnpike through Troop D. That coverage includes the Hudson County Extension, which runs from the Newark Bay Bridge to Exits 14A, 14B, and 14C near Bayonne, Liberty State Park, and the Holland Tunnel. A crash there produces a State Police report, not a Jersey City or Bayonne police report. Route 440 crashes are usually handled by the local department in whichever city the crash occurred.

Ask the responding trooper or officer for the report number before leaving. The State Police accept crash report requests online, and local departments have their own request processes.

    2. Why does it matter who owns the road?

A claim involving road conditions runs against a public agency. The Turnpike is operated by the New Jersey Turnpike Authority, and Route 440 is a state highway maintained by the New Jersey Department of Transportation. If a pothole, missing guardrail, or confusing lane shift contributed to the crash, the claim falls under the Tort Claims Act. That law requires a written notice of claim within 90 days under N.J.S.A. 59:8-8. You generally must also show that the agency’s failure to fix a known hazard was “palpably unreasonable” under N.J.S.A. 59:4-2.

    3. How do truck crashes change the claim?

They usually mean more insurance and more evidence. Since 2024, New Jersey has required commercial vehicles weighing 26,001 pounds or more to carry at least $1.5 million in liability coverage, double the federal minimum of $750,000. Interstate trucking companies must also follow federal hours-of-service rules, and most trucks record driving time electronically. Those logs, along with the truck’s onboard data showing speed and braking, can show whether a tired or speeding driver caused the crash. Ask promptly, in writing, that it be preserved.

    4. Why are interchanges and work zones so crash-prone?

Merging, weaving, and sudden slowdowns. The Exit 14 interchanges and the approaches to Route 440 pack lane changes into short distances. Long-running construction on the Newark Bay-Hudson County Extension adds shifting lanes and narrowed shoulders. Rear-end crashes are common where traffic stops without warning. New Jersey doubles fines for many traffic violations in designated construction zones.

    5. What if the other driver is from out of state?

You can still bring a claim in New Jersey, and your own Personal Injury Protection (PIP) coverage pays your medical bills regardless of fault. New Jersey’s deemer statute, N.J.S.A. 17:28-1.4, can apply New Jersey coverage requirements to out-of-state drivers whose insurers do business here. The two-year deadline for most injury lawsuits under N.J.S.A. 2A:14-2 applies no matter where the other driver lives.

    What’s the takeaway?
